摘　　要：[目的/意义]我国学界关于法律制度实效的研究相对比较缺乏。中国“拜杜规则”确立的目的之一是通过将专利产权赋予了项目承担单位,以提升财政资助完成的专利的利用率。良好的专利质量是提升专利利用率的先决条件。[方法/过程]以专利维持年限作为代理变量,运用虚拟回归的分析方法对我国高校和科研机构在“拜杜规则”前后的专利质量进行了分析。[结果/结论]研究发现,中国“拜杜规则”的确立和实施后专利质量出现下降。通过探究“拜杜规则”下产权激励的内在机理,为进一步深化改革科研体制奠定了实证基础,也在一定程度上拓展了我国法律制度实效研究的方法和手段。[Purpose/Significance]The research on the effectiveness of the legal system in China's academic circles is relatively lacking.One purpose of the establishment of the"Bayh-dole Rules"in China is to increase the utilization rate of government-fund patents by granting patent ownership to project undertakers.Good patent quality is a prerequisite for improving patent utilization.[Method/Process]In this paper,the duration of patent maintenance is taken as the proxy variable,and the virtual regression analysis method is used to analyze the patent quality of Chinese universities and research institutions before and after the"Bayh-dole Rules".[Result/Conclusion]It is found that the quality of patents declines after the establishment and implementation of the"Bayh-dole Rules"in China.By exploring the inherent mechanism of ownership structure under the"Bayh-dole Rules",this paper lays a certain empirical foundation for further deepening the reform of scientific research system,and to some extent,expanded the methods and means of studying the effectiveness of China's legal system.
