论黑社会性质组织犯罪涉案财产处置程序的完善

摘　　要：合理、正当的涉案财产处置程序,有利于铲除黑社会性质组织的经济基础,实现对黑社会性质组织犯罪的根源预防与合法财产、合法经营的有力保护。我国目前的黑社会性质组织犯罪涉案财产处置程序,有必要在涉案财产处置建议强制化、审理程序特别化、证明机制完备化方面完善:检察机关在提起公诉时必须一并提出涉案财产的处理意见及相关证据材料;明确规定相对独立的调查程序、灵活设定调查期限、合理规范“继续追缴”的后续程序;在涉案财产来源的证明中应引入推定规则,并适当降低涉黑财产的证明标准。The legitimate and justified disposal procedures of the property involved in the case are conducive to eradicating the economic foundation of the mafia-like organization and realizing the rooted prevention of Crimes committed by Mafia-like gang and strong protection of legal property and legal business.At present,it is necessary to perfect domestic procedures for the disposal of property involved in Crimes committed by Mafia-like gang by implementing the mandatory suggestion on disposal of property involved,specialized trial procedure and complete proof mechanism:Strictly requiring the Prosecutors Office to put forward the disposal opinions and relevant evidence materials of the property involved together when initiating the prosecution;Clearly stipulating relatively independent inves tigation procedures,flexibly setting investigation deadlines,and reasonably standardizing the follow-up procedures for"continued recovery";Introducing pres umption rules into the proof of the source of the property involved in the case,and appropriately lowering the proof standard of the mafia-like property involved in the crime.
