轻度精神发育迟滞性防卫能力评定的影响因素探讨

摘　　要：目的:探讨轻度精神发育迟滞患者性防卫能力评定的影响因素及相关法律问题。方法:采用自编法医精神病学鉴定案例登记表,对被鉴定的26例女性轻度精神发育迟滞患者的一般资料、性防卫能力评定结果及涉案资料逐一整理登记;登记表中的鉴定信息按智商(IQ)分为低智商组(IQ 50~59)和较低智商组(IQ 60~69),按有无接受监护人的性教育分为受教育组和未受教育组,采用百分比分别比较以上因素内部两组间性防卫能力评定结果的差异;对照性自卫能力评定量表(CSSD)评分结果,比较性防卫能力量表“存在/削弱”与“丧失”结构性评分的差异(计算百分比)。结果:较低智商组中性防卫能力评定为“存在/削弱”的比例(75%)高于低智商组(35.7%);受性教育组中性防卫能力评定为"存在/削弱"的比例(77.8%)高于未受教育组(41.2%);性防卫能力评定为“存在/削弱”者在“性自我保护”项得分偏高(≥8分)者占大多数(64.3%),性防卫能力丧失者在“性知识”及“性行为辨认能力”项得分低(≤2分)者占大多数(66.7%)。结论:要重视性教育及智商的差别对女性轻度精神发育迟滞患者性防卫能力的影响,而CSSD值得在性防卫能力鉴定实践中推广应用。Objective:To explore the influencing factors and related legal issues of the assessment of sexual defense ability in patients with mild mental retardation.Method:The self-made forensic psychiatric identification case registration form was used to sort and register the general information,sexual defense ability evaluation results.26 female patients with mild mental retardation were enrolled.The patients were divided into low IQ group(IQ 50-59)and lower IQ group(IQ 60-69)in terms of their IQ.According to the sex education received from their guardians,the patients were divided into education group and uneducated group.Percentages were used to compare the differences in the evaluation results of sexual defense capabilities between the two groups.The assessment results were compared with scores of CSSD(capacity of self defense scale),and the difference of"existing/weakened"and"loss"cases in CSSD was analyzed.Results:The ratio of the neutral defense ability of the lower IQ group rated as"existing/weakened"(75%)was higher than that of the low IQ group(35.7%);The proportion of the neutral defense ability assessment"existing/weakened"in the sex education group(77.8%)was higher than that in the non-education group(41.2%);The majority(64.3%)of those with a sexual defense ability rating of"existing/weakened"scored high(≥8 points)in the"sexual self-protection".The majority(66.7%)of those with low sexual defense ability scored low(≤2 points)in"sexual knowledge"and"sexual behavior recognition ability".Conclusion:The influence of differences in sex education and IQ on the sexual defense ability of women with mild mental retardation cannot be ignored,and CSSD is worthy of popularization and application in the practice of sexual defense ability identification.
