摘　　要：文化为制度之母,法乃文化的一种。对民法典深入解读必然会触及它赖以成型的文化基因。从法文化的视域审视,中国民法体系构建须关注中华传统文化的精神气质与现代民法文化的关联性。中国近现代的民法法典化运动,交织着对中华传统文化的承继和对现代民法文化的汲取,印证了中华传统文化与现代民法文化内蕴着人类社会共通的价值追求,两种文化的整合逻辑顺延出民法的民族性特质,这是对中国传统文化和现代民法文化的创造性升华。《民法典》将社会主义核心价值观作为立法宗旨,意蕴着鲜明的“中国特色”,彰显了中国文化自信,代表着中国民法文化发展的新高度,为世界民法典立法贡献了中国智慧,提供了中国经验。Culture is the mother of the system,and law is a kind of culture.An in-depth interpretation of the civil code is bound to touch the cultural genes on which it depends.From the perspective of legal culture,the construction of Chinese civil law system should pay attention to the relationship between the spiritual temperament of Chinese traditional culture and modern civil law culture.The modern civil law codification movement in China is intertwined with the inheritance of Chinese traditional culture and the absorption of modern civil law culture,which confirms that Chinese traditional culture and modern civil law culture contain the common value pursuit of human society.The logic of the integration of the two cultures extends the national Characteristics of civil law,which is the creative sublimation of Chinese traditional culture and modern civil law culture.The Civil Code regards socialist core values as the legislative purpose,implies distinct"Chinese Characteristics",highlights the confidence of Chinese culture,represents the new height of the development of Chinese civil law culture,contributes Chinese wisdom and provides Chinese experience for the legislation of the civil code of the world.
