摘　　要：法理学和伦理学从属于一个法治的文明史,我们从中可以确定法治文明发展的历程。伦理学是有关人们行为品性的学问。法律职业伦理是从事法律职业活动的主体应该具有的职业伦理。现代的法治国家都力图使法治精神、司法的独立性、正当的法律程序构成一个独立的法律活动系统,要求从事法律职业活动的人具有良好的专业素养,遵守法律程序,追求法律公正。在法律与伦理关系的融合中,法律并不会因此被化约成伦理。伦理的本质是关于道德问题的科学,是道德思想观点的系统化、理论化。伦理学关注的核心问题就是正当和善。我们立足法律职业伦理来探讨法律职业道德不仅为了知晓道德是什么,更为了展现自我、实现自我。法律职业的道德以“善”为核心,社会伦理以公平、正义为核心。因此,法律职业道德规范构建的基础,更多地在于寻求理性的辩护以及理论的支持,但同时也包含着规范系统与价值认定之间的联系,并涉及规范与“善”的关系。Jurisprudence and ethics are both the components of the same history of legal civilization,from which we can see the path of the development of legal civilization.Ethics is the study of people’s behavior and disposition and the professional ethics of law is the ethics that should be possessed by the subjects engaged in legal professional activities.Modern rule of law countries strive to make the spirit of the rule of law,judicial independence,and proper legal procedures constitute an independent system of legal activities,requiring those engaged in legal professional activities to have good professional qualities,abide by legal procedures,and pursue legal justice.In the integration of law and ethics,law will not be reduced to ethics.The essence of ethics is the science of moral issues,the systematization and theorization of moral ideas.The core concern of ethics is justice and goodness.Based on the professional ethics of law,we argue that the legal professional morality is intended not only to know what morality is but also for the legal professionals to show and realize themselves.The morality of the legal profession takes“goodness”as its core,and social ethics takes fairness and justice as its core.Therefore,the basis for the construction of the norms of legal professional ethics lies more in seeking rational defense and theoretical support,but at the same time it also contains the connection between the norm system and value recognition,and involves the relationship between norms and“goodness”.
