摘 要:近年来,自动驾驶技术飞速发展,自动驾驶汽车即将实现量产、普及,这给我国交强险制度带来考验。当前,交强险面临保险模式界定不清、分项责任限额救济力度不足、投保主体单一、保障范围狭窄的困境。因此,我国自动驾驶汽车强制保险方案应根据自动驾驶汽车不同的发展阶段而确定。在非完全自动驾驶阶段,可以适用无过失保险模式,采取车主严格责任,将汽车自动驾驶状态导致的损害纳入交强险保障范围,提高责任保险限额;在完全自动驾驶阶段,实行强制双保险制度,车主投保交通事故责任保险,汽车生产者投保汽车产品责任保险。In recent years,with the rapid development of self-driving technology,self-driving cars are about to achieve mass production,popularization,which gives a test to China’s insurance system.The insurance model is not clearly defined,the relief of the sub-liability limit is insufficient,the insurance subject is single,and the insurance scope is narrow.The compulsory insurance of self-driving cars in China should be based on the different stages of development of self-driving cars.In the stage of incomplete autopilot,the non-fault-free insurance model can be applied,the strict liability of the owner is adopted,the damage caused by the state of autopilot of the car is included in theinsurance coverage of the insurance,the limit of liability insurance is raised.In the stage of full autopilot,a compulsory double insurance system is introduced,the owner shall be insured for traffic accident liability,and the automobile manufacturer shall be insured for the liability of automobile products.
