摘 要:十八届四中全会提出的“推进以审判为中心的诉讼制度改革”,符合诉讼规律和司法规律,是破解制约刑事司法公正、加强人权司法保障的必由之路。经过多年的发展,我国刑事诉讼在制度层面具备了审判中心的核心内涵,但在刑事司法实践中仍然存在审判中心虚无的现象。造成司法实践中审判中心缺位的原因,不是侦查中心主义,而是部分司法人员未能严格按照刑事诉讼法的要求办理案件,即司法不严。因此,需要贯彻严格司法原则,通过建立刑事司法权运行的有效保障制度和刚性的监督制度,助力刑事诉讼制度中审判中心的全面实现。The decision of the Fourth Plenary Session of the 18th Central Committee of the Communist Party of China puts forward“promoting the reform of litigation system with trial judgment as the center”,which is in line with the law of litigation and the law of justice,and is the only way to solve the prominent problems restricting the justice of criminal justice and strengthen the judicial protection of human rights.After years of development,China’s criminal procedure has formed the core connotation of the trial center in the system level,but in the criminal justice practice,there still exists the phenomenon that the trial center is empty.The reason for the absence of the judicial center in judicial practice is not the investigation centralism,but the failure of some judicial personnel to handle cases in strict accordance with the requirements of the criminal procedure law,that is,the lax administration of justice.Therefore,it is necessary to implement the strict judicial principles,and to help the full realization of the trial center in the criminal procedure system by establishing an effective guarantee system and a rigid supervision system for the operation of criminal judicial power.
