摘　　要：网络刑事犯罪案件类型日新月异,新手段层出不穷,电子数据在刑事案件证据中的占比日益增加。实践中,电子数据的鉴定机构种类繁多、鉴定标准事项类型多样、鉴定文书的制作缺乏统一规范等问题导致鉴定文书的权威性难以得到保障。应科学设置鉴定单位,将公安机关作为电子数据鉴定的常设机构,并严格限定鉴定机构的业务范围、科学选择鉴定意见的载体、规范制作鉴定文书,以进一步完善电子数据的鉴定机制。With increasingly changing types of network criminal cases and endless emerging new means,the proportion of electronic data in the evidence of criminal cases is increasing day by day.In practice,the authoritativeness of electronic data authentication documents is difficult to be guaranteed due to the variety of authentication institutions,the diversity of authentication standard items,and the lack of unified standards in the production of authentication documents.Therefore,efforts should be made to establish scientific identification institutions,take the public security organs as permanent institutions for electronic data identification,strictly limit the business scope of the identification organs,scientifically select the carrier for appraisal opinions,and standardize the production of appraisal documents with a view to further improving the identification mechanism of electronic data.
