现代大学制度建设背景下公立高校内部人控制问题治理路径

摘　　要：高校内部人控制问题是指高校内部控制者为追求利益最大化,导致出现学校办学目标偏离、师生权益边缘化、学术自由受限、办学效益低下等问题,其原因主要在于公立高校产权主体不清晰、治理结构不完善、管理者选任缺乏竞争性、内部人控制法律机制不完善等。为此,可采用创新公立高校产权制度、健全公立高校治理结构、构建管理者市场化选任机制、完善内部人控制法律机制等措施,深入推进公立高校内部人控制问题治理,提高办学绩效。The issue of insider control in colleges and universities refers to the problems made by college insiders such as the deviation of the goal of running a school,the marginalization of the rights and interests of teachers and students,the restriction of academic freedom and the low efficiency of running a school by through control ofing the school in order to maximize its own interests.The major causes of these problems are the vague main body of property rights in public universities,the imperfect governance structure is not perfect,the lack of competitiveness among selection and appointment of managers is lack of competitiveness,the defective mechanism of internal regulation law is not perfect and so on.Therefore,our country should take many measures can be taken such as innovating the property right system of public colleges and universities,perfecting enhancing the governance structure of public colleges and universities,constructing the mechanism of market-oriented selection and appointment of managers,perfecting the legal mechanism of insider regulation,deeply promoting the governance of insider control questions problem-solving govermance of insider control in public colleges and universities,and improving the performance of running schools.
