摘 要:为保障大型客货车行车安全,配合“减量控大”等专项工作,公安交通管理部门针对疲劳驾驶交通违法行为开展取证执法,主要通过卫星定位的技术取证方式,利用行驶记录仪、动态监控平台的数据记录开展违法取证。本文从疲劳驾驶的法规界定入手,梳理了我国目前疲劳驾驶违法取证的法律法规、基础标准、操作规范、技术装备等取证技术体系,分析了现阶段取证工作存在的主要问题,结合现状提出下步深化取证执法工作的相关对策建议。In order to ensure the safety of large passenger coaches and freight vehicles and support the special work of"reducingthe number of traffic accidents and curbing the major ones",the traffic management departments of public security have carriedout the law enforcement and evidence collection work targeting the traffic violation behavior of fatigue driving,which is mainlyimplemented through satellite positioning and making use of the data from the driving recorder and the dynamic monitoringplatform.Starting from the definition of fatigue driving laws and regulations,the paper sorted out Chin's current legal system,basic standards,operation specifications,technical equipment and other forensic technology systems for fatigue drivingevidence collction,analyzed the main problems existing in the current forensic work and put forward relevant countermeasuresand suggestions for deepening the work of evidence collection and law enforcement.
