论第三方资助国际投资仲裁及其规制

摘　　要：第三方资助能够为投资者提起国际投资仲裁提供有力的物质支持,分担企业的运营风险,还能够在投资仲裁过程中为投资者提供法律技术方面的帮助。因此,投资者接受第三方资助的国际投资仲裁案件的数量正在不断增加。但是,非争端的第三方的加入可能引发投资仲裁参与者之间的利益冲突,影响仲裁员的公正性和独立性。投资者提起仲裁的成本因受到资助而降低,极易引发滥诉现象。同时,资助者为了保证从资助行为中获取利润,也可能会坚持要求进行仲裁,阻挠投资者与东道国之间的和解或调解,使得投资争端不能通过仲裁以外的方式解决。为了保证公正有效地解决国际投资争端,应当完善国际投资仲裁中的资助信息披露制度、费用担保制度以及费用分摊制度,对第三方资助国际投资仲裁进行规制。Third party funding can provide strong material support for investors to submit to international investment arbitration,share the operational risk of enterprises,and provide legal and technical assistance for investors in the process of investment arbitration.Therefore,the number is increasing of international investment arbitration cases concerning third party funding.However,the participation of a non-dispute third party may lead to conflicts of interest between the participants in the investment arbitration and affect the impartiality and independence of the arbitrators.The cost of arbitration brought by investors will be reduced because of the subsidy,which will easily lead to the phenomenon of abusive litigation.Meanwhile,in order to obtain profits from the financing behavior,the sponsor may insist on arbitration to obstruct the reconciliation or mediation between investors and the host country,so that investment disputes can not be settled by means other than arbitration.To ensure fair and effective settlement of international investment disputes,we should improve the funding information disclosure system,cost guarantee system and cost sharing system in international investment arbitration,and regulate the third-party-funded international investment arbitration.
