摘  要:新就业形态是伴随着互联网技术进步与大众消费升级出现的去雇主化、平台化的就业模式。当前新就业形态的劳动关系呈现复杂性、不稳定性和难于界定等特征,存在社保体系缺乏制度约束、劳动关系认定标准难以确定、从业者就业能力提升困难、收益分配不公平、工会维权陷入困境、纠纷增多等问题。要构建新就业形态和谐劳动关系,需要明确新就业形态和谐劳动关系的形成机制,采取建立“网上社保”、完善相关劳动法律法规、构建灵活培训体系、完善薪资激励体系、降低工会参与门槛、加强工会维权力度等策略。With the development of the Internet technology and the upgrading of mass consumption,the new forms of employment,employer-free and platform-based employmentforms,emerged.The current labor relations of the new forms of employment are characterized by complexity,instability and difficulty in their definition.There are many problems,such as lack of institutional constraints of the social security system,difficulty in determining the standards of labor relations,difficulty in improving the employability of practitioners,unfair income distribution,dilemma of labor union rights protection and increasing disputes.In order to construct harmonious labor relations in new forms of employment,it is necessary to make clear its formation mechanism,and adopt such strategies as establishing“online social security”,perfecting relevant labor laws and regulations,constructing flexible training system,perfecting salary incentive system,lowering the threshold of labor union participation,and strengthening labor union rights protection.
