论网上国际商事仲裁中仲裁地的选择与确认

摘　　要：网上仲裁作为争端解决方法的一种新形式,在国际商事纠纷中逐渐占据重要地位。由于其产生时间较短而遭遇了许多独有的法律问题,对仲裁地的确认就是其中之一。目前国际学界对仲裁地选择的代表理论有仲裁本座论、非内国仲裁理论等。非内国仲裁理论虽然使仲裁活动脱离仲裁地法的制约但仍不足以运用到实践当中,而仲裁本座论将仲裁地概念从地理概念升华为法律概念,减弱了仲裁地对仲裁程序的限制。因此,对网上国际商事仲裁的仲裁地选择应当根据仲裁本座论,由当事人事先约定一个仲裁地确定仲裁地法,将仲裁程序与仲裁地法连接,而未约定仲裁地的则根据最密切联系原则进行确定。As a new form of dispute settlement,online arbitration gradually plays an important role in international commercial disputes.Because of its short time,it has encountered many unique legal problems,and the confirmation of place of arbitration is one of them.At present,the representative theories about the choice of the place of arbitration in international academic circles include arbitration theory,non-native arbitration theory and so on.Although the theory of non-native arbitration makes the arbitration activity free from the law of the place of arbitration,it is still not enough to be applied to practice.And arbitrary theory has weakened the limitation of arbitrary place to arbitrary sequence by sublimating the concept of the place of arbitrary from geological notion to lawful idea.Therefore,the choice of arbitration place for online international commercial arbitration should be rooted according to arbitration theory,that is to say,the parties should agree on the place of arbitrary in advance so as to determine the law of the place of arbitration,and link the arbitration procedure with the law of the place of arbitration.But parties who didn't agree on any place of arbitrary should determine the law of the place of arbitration on the basis of the principle of the closest link.
