传播仪式观视阈下电影《黄克功案件》的法律传播效应与当代价值

摘　　要：根据1937年红军战斗功臣黄克功枪杀革命青年刘茜的历史事件改编的电影《黄克功案件》,在全面依法治国的当下,具有一定的现实法律传播效应和当代价值。从传播仪式观的视角分析,本文认为影片的法律传播效应在于:法律信仰传播的共同体构建;法律信仰传播场域的设定;“青天”文化的认同与弘扬。影片仪式化法律传播的当代价值在于:情理法冲突、权衡与取舍的正态文化传播;法治意识的传播;时代价值观的传播与确认。影片主旨不在于传递当时的法律理念,而在于引发观众对当下的法治、文化和价值观的思考与认可。Based on the historical event of Red Army battle hero Huang Kegong shooting revolutionary youth Liu Xi in 1937,the film A Murder Besides Yanhe River has certain legal communication significance and contemporary value in the current situation of comprehensively ruling the country by law.From the perspective of communication ceremony,this paper holds that the legal communication effect of film lies in:the community construction of legal belief communication;The setting of the field of legal belief dissemination;The recognition and promotion of“qingtian”culture.The contemporary value of the film ritualized legal communication lies in:the normal cultural communication of the conflict,balance and choice of rational law;Dissemination of awareness of the rule of law;The dissemination and confirmation of the values of the times.From the perspective of communication ritual,the theme of the film is not to convey the legal ideas of the time,but to arouse the audience's current thinking and recognition of the rule of law,culture and values.
