摘 要:对不当行政行为进行定性,学界有不同观点,大部分学者将不当行政行为界定为一种不违背法律法规规定的不适当、不合理行政行为。实际上不当行政行为应当是一种实质性违法行政行为,其对合理性的违背就是一种实质性违法,这是因为合理性是合法性的底线要求,即在合法性基础上对行政行为的基本要求。不当行政行为虽然不违背法律法规的明文规定,但它是违背法治原则、法治理念的,是一种“隐性”违法行为。针对其违法性,应当通过加强对其进行国家监察监督、将其致人损害纳入行政赔偿范围、将其纳入司法审查范围等方式来进行治理。There are various opinions about the nature of mal-administrative act in academia,and it is defined as an inappropriate or unreasonable act which it do not violate the law by most of the scholars.Mal-administrative act ought to be a unlawful act in essence because it violate reasonability.Reasonability is the basic requirements of legitimacy,and it also is the basic requirements of administrative act basing on reasonability.Although mal-administrative act do not violate laws and regulations,and it violate the principle and idea about rule of law.Mal-administrative act should be a hidden unlawful act.We ought to governance mal-administrative act by the state supervision,and the damaged interest is compensated,and it should be brought into the scope of judicial review.
