认罪认罚从宽制度下量刑建议精准化研究

摘　　要：随着认罪认罚从宽制度试点改革的深入推进,量刑建议是采用"幅度刑"还是"确定刑"成为各界争议的热点。与一般案件中量刑建议仅提供参考作用不同,认罪认罚案件中量刑建议凝聚了控辩审三方共识,对法官具有相对刚性的拘束力,一定程度上体现了量刑权的共享化。而量刑建议精准化可以激励犯罪嫌疑人认罪认罚,保障控辩双方平等协商,确保同案同判,规避控审诉讼风险,推动认罪认罚从宽制度发展。基于以上量刑建议程序功能的考虑,检察机关应贯彻宽严相济刑事政策,在程序上完善协商机制,确保量刑建议体现量刑优惠;也应以罪责刑相适应原则为导向,在实体上联合最高法出台量刑建议指导意见,优化量刑建议质量。With the deepening of the pilot reform of the system of pleading guilty and accepting punishment,it has become a hot issue whether to adopt“range penalty”or“definite penalty”in sentencing recommendation.Differ⁃ent from the sentencing recommendations in general cases only for reference,the sentencing recommendations in pleading guilty cases reach a consensus of the three parties of prosecution,defense and trial,and have relatively rig⁃id binding force on judges,to some extent,which reflect the sharing of sentencing right.The definite sentencing rec⁃ommendations can encourage the suspects to plead guilty and accept punishment,ensure equal consultation between the prosecution and the defense,ensure the same case with the same sentence,avoid the litigation risk of the prose⁃cution and the trial,and promote the development of the system of pleading guilty and accepting punishment.Based on the consideration of the above procedural function of sentencing recommendations,the procuratorate should imple⁃ment the criminal policy of leniency with sternness,improve the consultation mechanism in the procedure,and en⁃sure that sentencing recommendations reflect sentencing discount;also,it should be guided by the principle of match⁃ing punishment with crime and responsibility,and issue substantive sentencing recommendations guidelines with the supreme court,to optimize the quality of sentencing recommendations.
