摘　　要：《人民陪审员法》的出台标志着人民陪审员制度进入了一个崭新时代。这不仅是着力推进司法民主的一项重大举措,也是以审判为中心的司法制度改革的关键部署。根据审判独立原则,作为独立裁判主体,人民陪审员应当被赋予合理、充分的裁判权。就此而言,科学地在裁判主体之间配置裁判权,既是人民陪审员制度所理应实现的改革目标,也是提升审判质量的必然要求。因此,从裁判权配置角度审视这部法律极具理论意义。大体而言,当前《人民陪审员法》在“裁判权的逻辑界分”和“表决权的份量分配”这两个维度上都存在着逻辑上的不一致性,由此引致了相应的逻辑问题或悖论。而这类逻辑性问题很可能造成未来制度运行和司法实践方面的困境。概而言之,尽管总体上我国人民陪审员制度踏上了一个新的发展起点,但这场改革未完待续且任重道远。The promulgation of the Law of the People’s Republic of China on People’s Assessors marks the beginning of a new era for the people’s jury system in China.This is not only a major measure for China to promote judicial democracy,but also a key deployment of the judicial system reform.According to the principle of independent trial,as an independent referee,the people’s jurors should be given reasonable and sufficient jurisdiction.In this regard,the scientific allocation of jurisdiction among the referees is not only the reform goal that the people’s jury system should achieve,but also the requirement for improving the quality of the trial.Therefore,it is of great theoretical significance to examine this law from the perspective of the allocation of jurisdiction.Generally speaking,the current Law of the People’s Republic of China on People’s Assessors has some logical inconsistency in the two dimensions of“the logical division of jurisdiction”and“the distribution of voting rights”,which leads to corresponding logic problems or paradox.Such logic problems are likely to cause difficulties in the future operation of the system and judicial practice.In a nutshell,although the people’s jury system in our country has embarked on a new development starting point,this reform has not been completed and has a long way to go.
