摘 要:正确理解和适用《海洋环境保护法》第89条第2款的规定,是海洋环境民事公益诉讼得以顺利推进的关键。第89条第2款非海洋环境民事公益诉讼适格原告的特别规定,而是补充性规定。海洋环境民事公益诉讼适格原告的确定应遵循《民事诉讼法》《环境保护法》及其司法解释中确定的一般规则。海洋环境行政监督管理部门、社会组织、检察机关均可作为适格原告。在出现海洋环境污染、生态资源破坏时,应形成海洋环境行政监督管理部门为主导,社会组织为补充,检察机关侧重司法监督的原告顺位。In order to promote the civil public interest litigation on marine environment smoothly,the key is to correctly understand and apply the stipulations in Clause 2,Article 89 of the Marine Environmental Protection Law of the PRC.This clause is not stipulated particularly for the qualified plaintiff in the civil public interest litigation on marine environment,but supplementary.The qualification of the plaintiff in the civil public interest lawsuit on marine environment should follow the general principles in the Civil Procedure Law of the PRC,the Environmental Protection Law of the PRC and their judicial interpretations.Marine environmental administrative institutions,social organizations,procuratorates can be considered the qualified plaintiffs.When it comes to the marine environmental pollution and sabotage of ecological resources,the litigation plaintiff should be led by the marine environmental administrative institutions,assisted by the social organizations and supervised by the procuratorate.
