摘 要:保险代理关系与劳动关系,为保险营销员与保险公司常见的两种法律关系。单纯从二者的概念上来看,似乎界限分明、易于分辨,但在实践中却出现了诸多类似竞合情形,给保险营销员的法律地位认定带来了困难。在对其进行认定时,应当将从属性判断置于一个更为严格的标准之上,如此方能对保险公司的管理行为性质进行有效区分;此外,针对实践中出现的担任双重职务的保险营销员,应当重点审查非保险代理职务与保险代理工作之间的关系,并结合从属性标准进行实质性判断。Insurance agency relations and labor relations are two common legal relations between insur⁃ance marketers and insurance companies.Judging from the concepts of the two,it seems that the boundary is clear and easy to distinguish,but in practice,many similar competitions have emerged,which makes it diffi⁃cult for the insurance marketer to determine the legal status.When identifying it,attribute judgment should be placed on a more stringent standard,so that the nature of the insurance company’s management behavior can be effectively distinguished;in addition,the insurance marketing for dual positions in practice The employee should focus on examining the relationship between non-insurance agency duties and insurance agency work,and make substantive judgments in accordance with the subordinate attribute standards.
