摘　　要：如何判定销售含氟苯尼考鸡蛋行为的性质,这是当下市场监管部门在执法中面临的一个突出问题。从氟苯尼考在鸡体内的休药期和残留消除规律来看,技术标准规定的“产蛋期禁用”不等同于“鸡蛋中不得检出”。我国近期制定的《食品中兽药最大残留限量》代替了《动物性食品中兽药最高残留限量》,成为新的技术标准,也是鸡蛋的食品安全标准。但是,该标准没有规定氟苯尼考及其代谢物(氟苯尼考胺)在鸡蛋中的最高残留限量值(MRL),因此,参考氟苯尼考在鸡靶组织体中的MRL值和人体的日均允许摄入值(ADI)值来判定鸡蛋中氟苯尼考是否超标,是执法的权宜之策。销售含氟苯尼考鸡蛋的行为具有复合性,对其性质的判定不能一概而论,执法者应视氟苯尼考超标程度来进行判定。A pressing question faced by market regulatory authorities is how to judge the distribution of eggs containing florfenicol in law enforcement.In terms of the withdraw time of florfenicol in chickens and the residue depletion pattern,the stipulation of“banned during laying cycle”in technical standards is not equivalent to“florfenicol should not be detected in eggs”.China’s newly formulated Maximum Residue Limits for Veterinary Drugs in Food has replaced Maximum Residue Limits for Veterinary Drugs in Food of Animal Origin as the new technical standards for food safety including eggs.However,the standards did not stipulate the MRLs of florfenicol or of its active metabolite(florfenicol amine)in eggs.It is therefore an expedient for law enforcement to judge whether florfenicol in eggs exceeds the standard by referring to the maximum residue limit(MRL)of florfenicol in chicken target tissues and the acceptable daily intake(ADI).The behavior of distributing eggs containing florfenicol is complex,and its determination cannot be generalized.Law enforcers should judge the behavior according to the level of florfenicol exceeding the limits.Where a distributer carries out the act of distributing eggs containing florfenicol exceeding the limits,but actively fulfills the obligation of stock inspection,proves that there is no subjective intent for the violation and truthfully accounts for the source of eggs,it is still possible that they be exempted from punishment.
