学位论文数据库网络出版授权中的法律问题

摘　　要：目前,学位论文数据库网络出版的权源主要来自高校的转授权,但学校原获得授权本身的法律效力、授权性质、授权种类等直接影响转授权是否成立及学位论文网络出版是否具有法律依据,仍需进一步讨论。为避免可能带来的侵权纠纷,学位论文网络出版时,应厘清作者、学位授予单位、中国科学技术信息研究所、数据库建设单位之间的法律关系;依法认真审核授权书;重构授权模式,变间接授权为直接授权。At present,the right source of network publishing of dissertations database mainly comes from the University’s authorization,but the legal effect,nature and types of authorization of the University’s original authorization directly affect whether the authorization is established and whether the online publication of dissertations has legal basis.In order to avoid possible infringement disputes,it is necessary to clarify the legal relationship among the author,degree awarding department,China Institute of Science and Technology Information,and database construction department.We should carefully examine the power of attorney in accordance with the law,reconstruct the authorization mode,and change the indirect authorization mode into the direct authorization mode.
