摘  要:我国劳务派遣规制设计了劳务派遣单位对被派遣劳动者、用工单位对被派遣劳动者的直接和间接责任机制两大类、四小类权益保护机制。但四个机制涉及主体的权利义务关系存在法律适用和法律关系属性不明等问题,给保障劳动者权益带来风险。完善劳务派遣规制,应将劳务派遣形成的"三方"劳动关系视为区别于传统"二方"劳动关系的特殊劳动关系,劳务派遣协议应为劳务派遣单位、被派遣劳动者以及用工单位三者间的协议。《劳动法》应就这一特殊劳动关系以及三方主体间的权利义务进行清晰界定。China’s labor dispatch regulations have designed with two categories of direct and indirect responsibility of labor dispatch units to dispatched workers and employing units to dispatched workers,including four subcategories of right and interest protection mechanisms.However,the relationship of rights and obligations among the subjects involved in the four mechanisms has some problems,such as the application of law and the unclear nature of legal relationship,which bring risks to the protection of workers’rights and interests.To improve the labor dispatch regulations,we should regard the"three-party"labor relationship formed by labor dispatch as a special labor relationship different from the traditional"two-party"labor relationship.A labor dispatch agreement should be an agreement among the labor dispatch unit,the dispatched workers and the employing unit.The Labor Law should clearly define this special labor relationship and the rights and obligations of the three parties.
