摘 要:我国行政公益诉讼理论是近年来法学界关注的焦点问题之一,但其理论意旨与制度建构仍然停留在权力制约的基础之上,忽视了国家与社会对话、公法权利与私法权利的沟通,以及公共利益与私人利益的融合,容易引导行政公益诉讼理论与制度走向歧途。因此,以国家治理现代化为视角,运用国家和社会、公法权利与私法权利、公共利益与私人利益三对范畴,从3个维度反思当前行政公益诉讼基本理论,以摒弃国家与社会之间的对立,破除私人邻域和公共邻域的藩篱,实现公共利益和私人利益的融合,为行政公益诉讼制度的完善奠定理论基础。The theory of administrative public interest litigation in China is one of the focuses of the legal circle in recent years.Its theoretical intention and system construction remain on the basis of the balance of power,ignoring the existence of civil society factors,the dialogue between public rights and private rights,as well as the integration of public interests and private interests,leading the theory and system of administrative public interest litigation to go astray.Therefore,from the perspective of the modernization of national governance,the country can reconstruct current administrative public interest litigation theory on the basis of three categories:the state and society,public rights and private rights,public interests and private interests,which abandons the opposition between the state and society,removes the barrier between the private and public rights,realizes the integration of public interests and private interests,so as to lay the theoretical foundation for the perfection of administrative public interest litigation system.
