摘 要:全面实施依法治国和推进依法治教要求完善教育法治建设。新颁布的《民法典》丰富了我国的立法实践,以法典化引领教育立法为我国教育法提供了新的立法思路。教育法的法典化是针对教育领域内所有法律关系而制定一部具有基础性和权威性的《教育法典》。编纂《教育法典》应当加强全国人大的主导性,发展“一揽子修法”的立法思路,并参考借鉴域外教育法典的有益经验,探索编纂适合中国国情和实际的《教育法典》。此外,编纂《教育法典》需要加强关于立法原则、法典设计价值、法典编纂技术、法典体例编排、法典与其他法律和国际规范的衔接的理论研究。In order to fully implement ruling state by law and promote managing education by law,it is imperative to enhance the rule of law in the education arena.The newly promulgated Civil Code enriches lawmaking practice in our country and provides a codification approach for Chinese education law-making.The codification of education law aims to formulate a basic and comprehensive Education Code governing all legal nexuses in the field of education.In the process of codifying education law,National People's Congress plays the leading role to formulate an education code suitable for China's national conditions and reality by improving the approach of"package amendment"and borrowing successful experience of education codification from other jurisdictions.Moreover,the codification of education law also requires the improvement of theoretical research on the principle of law-making,legal values of codification,legislative techniques,the formation of education code,as well as the relationship between education code and other legal rules.
