摘 要:我国行政公益诉讼制度的正式确立已有三年,尽管在《行政诉讼法》修改之前,实务界和理论界都已对此制度进行了大量的实践和深刻的讨论。但是新修改的《行政诉讼法》第二十五条第4款规定相对简单,一些问题并未因其修改而得到解决。因此,文章通过对相关案例的整理,以实证分析的方法指出目前行政公益诉讼受案范围仍然较小、诉前程序不完善、履行判决的标准不明确等问题,对行政公益诉讼制度正式实施以来进行阶段性总结。It is three years now since China's administrative public interest litigation system was formally established.Before the"Administrative Procedure Law"was revised,both practical and theoretical circles had conducted a lot of practice and in-depth discussions regarding this system.However,the Paragraph 4 of Article 25 in the newly revised"Administrative Procedure Law"is not clear and comprehensive enough and some problems have not been resolved accordingly.Therefore,by sorting out relevant cases,the article points out three problems concerning it:the scope of administrative public interest litigation is still small,the prelitigation procedures are not perfect enough,and the criteria for fulfilling judgments are not clear,which is aimed at a summarizing to situation over the stage since the implementation of the administrative public interest litigation system till present.
