认罪认罚从宽制度中的几个争议问题

摘　　要：刑事诉讼法在认罪认罚从宽制度中虽未出现“控辩协商”这一词语,但规定了控辩协商程序。我国控辩协商的最大特色和优势在于,把依法办案与控辩协商、法定从宽与协商从宽有机结合起来,兼收二者之利。控辩协商的基本要求包含目标、原则、内容、成果载体、质量评价尺度等要素。法律赋予了控辩合意所形成的量刑建议对法院“有条件的拘束力”。《刑事诉讼法》第201条第2款从属于第1款第5项,系对第5项“其他影响公正审判的情形”中“法院认为量刑建议明显不当或者被告人、辩护人对量刑建议提出异议”这种情形的解决方式的规定,但法条的表述需要完善。法院认为量刑建议明显不当应当告知检察院,只有检察院不调整量刑建议或调整量刑建议后仍然明显不当时,法院才能依法作出判决。Although the term"charge and defense negotiation"does not appear in the leniency system of confession of guilt and punishment in the Criminal Procedure Law,it stipulates the procedure of charge and defense negotiation.The biggest characteristic and advantage of the charge and defense negotiation in China lies in the organic combination of handling cases in conformity with legal provisions,charging and defensing negotiation and statutory leniency and negotiation leniency.The basic requirements of charging and defensing negotiation include objectives,principles,content,outcome carrier,quality evaluation criteria and other elements.The law gives the sentencing proposal formed by the agreement of prosecution and defense"conditional binding force"to the court.In the Criminal Procedure law,term 201,article 2 is subservient to article 1,paragraph 5.It is the resolution of the situation that"other circumstances affecting a fair trial",in which"the court finds that the sentencing recommendation is manifestly improper or the defendant or defender objects to the sentencing recommendation",in the paragaph 5.But the wording of the law needs to be improved.The court considers that the sentencing suggestion which is obviously improper should inform the procuratorate.Only when the procuratorate does not adjust the sentencing suggestion or the sentencing suggestion is still obviously improper can the court make a judgment according to law.
