摘 要:当前,我国食品民事公益诉讼主要为检察机关刑事附带民事诉讼的形式。这虽然有利于打击违法犯罪行为,但与刑附民程序规定并不契合,还容易引发制度紊乱。一则与立法规定检察机关为补位主体的定位不符,削弱了社会监督功能;二则检察机关提起惩罚性赔偿,请求权基础与诉求内容不匹配,赔偿款的处理也存在不当;三则与消费者诉讼机制衔接不足。为回归社会监督的制度本位,应设定刑附民程序和惩罚性赔偿适用条件,并完善与消费者诉讼的协同措施。At present,the civil public interest litigation of food in China is mainly in the form of civil action incidental to criminal proceedings of procuratorial organs. Although it is conducive to cracking down on crime,it doesn’t fit into the penalty attached to the civil procedure provisions,and causes the system disorder. Firstly,it is inconsistent with the legislation that procuratorial organs are the subject of complement,which weakens the function of social supervision. Secondly,procuratorial organs raise punitive damages,but the basis of the right to claim does not match the content of the claims,and the handling of compensation is improper. Thirdly,procuratorial organs are insufficiently connected with the consumer litigation mechanism. In order to return to the social supervision system,we should set up the penalty attached to the civil procedure and punitive compensation applicable conditions,and improve the measures of coordination with consumers.
