摘　　要：新型非法吸收公众存款是利用网络技术衍变出的涉众型金融犯罪新样态,具有隐蔽性更强、手段更新、整体性更明显、网络化与组织性更突出等特征,加大了司法机关对其发现、认定、调查、取证等方面的打击难度。新型非法吸收公众存款犯罪严重危害国家金融安全、社会稳定以及人民群众切身利益。为了防范和化解新型非法吸收公众存款带来的重大金融风险,检察机关应加强刑事司法介入的职能,坚持打防结合,强化内外联动,通过提升刑事打击能力基础、创新运用监督监管手段、构建协作共建机制等措施,建立司法机关治理新型非法吸收公众存款犯罪的工作体系,在推进国家治理体系和治理能力现代化中体现出检察机关的责任担当。The new type of illegal absorption of public deposits is a new form of stakeholder-type financial crimes evolved from using network technology.Its characteristics of stronger concealment,newer means,more obvious integrity,more prominent networking and organization make it difficult for judicial organs to crack down on its discovery,identification,investigation and evidence collection.The new type of crime of illegally absorbing public deposits seriously endangers national financial security,social stability and the vital interests of the people.In order to prevent and resolve the major financial risks brought by the new illegal absorption of public deposits,procuratorial organs should strengthen the function of criminal judicial intervention,combining punishment and prevention,and strengthening internal and external cooperation.We hold that it is necessary to establish a working system for judicial organs to deal with new crimes of illegally absorbing public deposits and to take the responsibility in promoting the modernization of national governance system and governance capacity by improving the foundation of the ability to strike crimes,by using innovative supervision means,and by building a cooperative and co-construction mechanism.
