摘　　要：大数据背景下,探讨个人信息保护立法无法脱离数据治理的议题。只有引入数据治理视角,才能有效解决个人信息立法困境,全方位构建个人信息保护法律体系。从数据治理视角开展个人信息保护的具体措施包括:将个人信息保护拓展为个人信息及数据立法保护、重视立法个体的自然人特性、采取分级分类保护机制、规避数据治理过程中的"算法陷阱"。We are in a world of big data,the discussion of personal information protection legislation can not be separated from data governance.Only by introducing the perspective of data governance,we can effectively solve the dilemma of personal information legislation and build a comprehensive legal system of personal information protection.The specific measures to protect personal information from the perspective of data governance include the following aspects:the protection should be extended to personal information and data protection,pay attention to the natural person characteristics of legislative individuals,establish classified protection mechanism,and avoid the"algorithm trap"in the process of data governance.
