摘　　要：虽然区块链技术是集成性的创新技术,其运用代码创设的共识机制、算法机制和激励机制等,却具有法律制度的基本属性和功能。在区块链技术的诸多运行机制中,激励机制处于核心地位,其在驱动整个区块链的良性运行中发挥着巨大作用。区块链技术激励机制具有法律制度的基本属性和功能,因此其也具有法律制度应有的基本价值。从理论研究视角和实际运行情况进行考察,区块链技术激励机制的制度价值包括效益价值、安全价值、公平价值、秩序价值、自由价值和人权价值。这些积极正向的基本价值成为引领区块链技术健康运行和相关应用良性发展的核心动力,不断为实现国家治理体系和治理能力现代化提供技术支持和智慧方案。Although blockchain technology is an integrated and innovative technology,the consensus mechanism,algorithm mechanism and incentive mechanism created by code have the basic attributes of legal system.Among many operating mechanisms,incentive mechanism is at the core and plays a huge role in the benign operation of the whole blockchain.The incentive mechanism also has the basic value due to legal system.From the perspective of theoretical research and actual operation,the basic value of the incentive mechanism of blockchain technology includes benefit value,security value,fair value,order value,freedom value and human rights value.These basic values have become the core driving force for the healthy operation and high-quality development of blockchain.
