中亚五国艺术产权生态及其规范体系探析

摘  要:艺术产权生态是艺术与环境双向互动关系,生态系统包括艺术家要素、环境要素、可持续发展要素。中亚五国艺术产权生态具体内容的最主要影响因子是国家历史、政治、经济、文化、法制。艺术产权规范体系以国内规范为主,国际相关公约也是构成体系的重要组成。中亚五国艺术产权规范体系,有共性也有差异,显示民族历史秉性,体现各国音乐产权生态特色。中亚五国艺术产权综合反映了各国国情,研究它们对促进我国与这些国家民心相通有重要价值。Art property rights ecology is a two-way interaction between art and environment.Ecosystem includes artist elements,environmental elements and sustainable development elements.The most important factors influencing the specific content of art property rights in five Central Asian countries are national history,politics,economy,culture and legal system.Art property right regulation system is dominated by domestic regulations,and related international conventions also constitute an important part of the system.Normative systems of art property rights in five Central Asian countries have commonalities and differences,showing their national historical characteristics and reflecting ecological characteristics of music property rights in various countries.Art property rights of five Central Asian countries comprehensively reflect national conditions of each country,and studying them is of great value in promoting communication between China and these countries.
