摘 要:职业精神障碍患者无法寻求合适的法律救济的案例早已屡见不鲜。通过对与职业精神障碍相关的司法案例的统计、整理和分析可见,职业所致精神障碍可分为致纯粹精神障碍、工伤伴发精神障碍以及致精神障碍而引发心脑等疾病三种类型,其中任何一种类型都很难最终认定为工伤。比较域外体例可见职业所致精神障碍的工伤认定模式大致有两种:一种是心理压力事件列举与评估模式,一种是事故伤害认定模式。我国现有制度仍是以扩张解释来应对日益严重的职业精神障碍问题,应通过专门立法来单独规定职业所致精神障碍的工伤认定,在区分纯粹精神障碍和伴发精神障碍的基础上,形成详细的认定标准以及相关的配套制度。It is common for people with occupational mental disorders not to be able to seek appropriate legal relief.Through the statistics,collation and analysis of the judicial cases of occupational mental disorders,it is found that occupational mental disorders can be divided into three types:pure mental disorders,mental disorders caused by work-related injuries,and heart and brain diseases due to mental disorders,all of which are hard to be identified as work-related injuries.In foreign cases,there are generally two types of occupational injury identification modes for mental disorders caused by occupation:one is accident injury identification mode,and the other is psychological stress event enumeration and evaluation mode.China’s existing system still deals with the increasingly serious problem of occupational mental disorders on the basis of extensive judicial interpretation.In the future,special legislation shall be adopted to separately regulate the identification of occupational mental disorders.While distinguishing pure mental disorders from concomitant mental disorders,the new law shall include detailed identification standards and relevant supporting systems.
