从单向走向互动的破产府院联动机制——以我国法院的破产能动司法为中心

摘　　要：我国地方法院在破产司法实践中探索建立的破产府院联动机制,作为解决破产程序衍生社会问题的具有历史阶段性的个案协调措施,呈现出司法权请求行政权支持的单向性特征。同时,实践中我国破产法院探索以能动司法的方式参与社会治理,彰显出司法权对行政权的反作用力。现代法治社会中的权力结构以有效回应社会需求为目标,衍生出能动司法的范畴,并成为破产府院联动机制转变方向的理论渊源。破产司法权中蕴含着能动司法的因素,破产能动司法的妥当运行应当坚守合法性原则,这也是能动司法保持正当性的前提。为完善双向互动的破产府院联动机制,宜当设置破产服务局以明晰司法权与行政权的职能范围,在法治的框架内发挥各项权力参与社会治理的智慧。Local courts in China explored and established the interaction mechanism between the government and the courts in bankruptcy as a historical phased coordination measure aimed at cases,to solve the social problems derived from bankruptcy proceedings,presenting the unidirection characteristic of judicial power appealing for the support of executive power.At the same time,in practice,the courts are trying the bankruptcy cases in China participated in social governance by judicial activism,manifesting the reaction of judicial power over executive power.The power structure in the modern society with rule of law aims at responding effectively to the needs of society.It has derived the concept of judicial activism and has become the theoretical source for the direction change of the interaction mechanism between the government and the courts in bankruptcy.The judicial power of bankruptcy contains the factors of judicial activism.The proper operation of judicial activism in bankruptcy should be based on the principle of legitimacy,which is also the premise of maintaining justice of judicial activism.In order to improve the bilateral interaction mechanism between the government and the courts in bankruptcy,it is advisable to set up Insolvency Service to clarify the functional scope of judicial power and executive power,and exert the wisdom of various powers to participate in social governance within the framework of the rule of law.
