我国院前急救地方立法现状、问题与建议

摘　　要：通过检索北大法宝、法律图书馆等法律数据库,对我国42部院前急救地方立法的立法地区、效力级别、体例结构、立法时间、立法名称及立法内容进行深入分析,指出院前急救地方立法中存在法律规定不足,院前急救体制机制不健全,社会急救制度供给不足等问题。同时借鉴国外比较成熟的急救立法经验,建议提升院前急救立法层级,健全院前急救体制机制,完善社会急救制度,建立院前急救监督执法体系,为完善我国院前急救立法体系提供参考。By searching the legal databases such as The Magic Weapon of Peking University and The Law Library,this paper conducts an in-depth analysis of the legislative areas,the level of effectiveness,the style and structure,the legislative time,the legislative name and the legislative content of the 42 pre-hospital emergency local legislations in China.It presents some problems in the local legislation of pre-hospital emergency,such as legal provisions deficits,unsound system and mechanism of pre-hospital emergency,and insufficient supply of social emergency system.At the same time,drawing on the relatively mature oversea experience,this paper puts forward some suggestions:to enhance the level of pre-hospital emergency legislation,perfect the system and mechanism of pre-hospital emergency,perfect the social emergency system,and establish the pre-hospital emergency supervision and law enforcement system,so as to provide reference for improving the legislative system of pre-hospital emergency in China.
