摘　　要：当前中国医疗知情同意代理制度中存在着一些问题:代理权与生命权、隐私权等权利存在冲突,代理主体立法不统一和代理顺序未明确,代理权限缺乏限制和行使缺少监管,代理实践中救济途径不足与法律缺乏操作性等。通过实证研究和法理分析探究我国医疗知情同意制度的完善路径,结合中国国情借鉴国外的知情同意能力认定标准、医疗预先指示、代理能力审查等制度经验,针对当前中国知情同意代理制度的困境提出了强化代理原则指导、完善代理主体立法、多方限制代理权限、衔接家庭医生制度等建议。The current medical informed consent agency system in China has many flaws, such as the conflicts between the agency power, the right to life and the right to privacy, the inconsistency of the agency legislation, undefined agent order, the lack of restrictions and supervision of the agency authority, the insufficiency of the remedies in the agent practice and the lack of the operability of the law, which lays hidden dangers for medical disputes.Through empirical research and Legal analysis,this paper explored the path to improve china’s medical informed consent system.learned from the experience of reforming foreign informed consent capability recognition standards, medical advance directives, agency capability review and combined with China’s national conditions. Aiming at the dilemma of the current informed consent agency system of China, the paper put forward a number of proposals such as strengthening the guidance of agency principles, perfecting the legislation of agency subjects, restricting the authority of agencies by multiple parties, and connecting the family doctor system.
