第一次讯问的行为视角研究

摘　　要：第一次讯问是指侦查人员对特定犯罪嫌疑人实施的第一次讯问行为。基于指导办案实务的考虑,从理论上对第一次讯问行为进行总结和凝练具有重要意义。结合侦查实务工作运行情况,应当基于查明犯罪和固定口供的双重行为导向,并结合排除可翻供因素以支持诉讼的行为导向进行探讨第一次讯问行为。侦查人员通过实施第一次讯问活动,一是要突破犯罪嫌疑人口供查明犯罪事实,以实现侦查权打击刑事犯罪的职能;二是要对第一次讯问所涉及相关证据进行固定和查证,以保障和推进诉讼程序进行。The first interrogation refers to the behavior of the firstly interrogating on a specific criminal suspect by investiga⁃tors.Based on the consideration of guiding case-handling practice,it is of great significance to summarize and condense the first interrogation behavior theoretically.Combined with the actual operation of investigation,the conduct of the first interrogation should be studied based on the dual behavior orientation of identifying the crime and fixed confession,and the behavior orientation of eliminating the factors of retracting confession to support the lawsuit.By conducting the first interrogation,investigators should break through the criminal suspects’confession to ascertain the criminal facts,so as to realize the function of cracking down on crimes with the power of investigation.Moreover,the relevant evidence of the first interrogation should be fixed and verified to en⁃sure the procedure of the lawsuit.
