摘　　要：《社区矫正法》施行以来,恢复性司法理念获得认同,司法行政机关从事社区矫正“合法性危机”得以化解,社区矫正工作体制基本建立,社区矫正检察监督及时跟进;但在刑罚理念、法律修缮、机构设置、社会力量参与等方面与立法预期、社会期待还有差距。为此,立法部门应梳理与修缮现行规范性文件,地方政府应尽快设置区/县社区矫正机构,社区矫正机构不应忽略教育帮扶的针对性与有效性。对于检察机关而言,既要提升社区矫正检察监督的刚性,又要让基层社区矫正工作人员权责一致、尽职免责,不应让个人为体制付出代价。Since the implementation of the Community Correction Law,the concept of restorative justice has been recognized,the judicial administrative agency’s“legitimacy crisis”in community corrections has been resolved,the community corrections work system has been?basically established,and community corrections inspection and supervision have followed up in time.However,there is still a gap with legislative expectations and social expectations in terms of the concept of penalties,legal amendments,institutional settings,and the participation of social forces.For this reason,the legislative department should sort out and revise the current normative documents,local governments should set up district and county community corrections institutions as soon as possible,and community corrections institutions should not neglect the pertinence and effectiveness of education assistance.For procuratorial organs,it is necessary to increase the rigidity of community corrections procuratorial supervision,and to make grassroots community corrections staff consistent in their rights and responsibilities,and to perform their duties and exempt them from responsibilities.Individuals should not be allowed to pay for the system.
