摘 要:现阶段,京津冀三地如何发挥旅游资源优势互补,实现旅游产业协同发展及促成旅游市场统一有序等,都亟需以法治思维和法治手段予以调整和规范。京津冀区域旅游法治作为独立于三地之上的整体性治理模式,具有自身特点及其建设的必要性。当前,区域旅游软硬法立法失衡,执法合作条件不充分,协同司法受到主客观因素制约等,是京津冀区域旅游法治建设面临的主要问题。在此基础上,从立法、执法、司法等方面提出综合性对策方案,构建京津冀区域旅游治理法律体系及提升其依法治理的实践能力。At present,all of these need to be adjusted and standardized by legal thinking and legal means,which including how to give full play to complementary advantages of tourism resources,realize coordinated development of tourism industry,and promote unity and order of tourism market in Beijing,Tianjin and Hebei.As an integral governance mode independent of Beijing Tianjin Hebei regions,the rule of law to regional tourism has own characteristics and the necessity of its construction.Now,the main problems faced by construction of rule of law to regional tourism are the imbalance of legislation of tourism soft and hard law,the inadequate conditions for law enforcement and cooperation,and the subjective and objective constraints of collaborative justice in Beijing,Tianjin and Hebei.On this basis,this paper puts forward comprehensive countermeasures from the aspects of legislation,law enforcement and justice,trying to build the legal system of tourism governance in Beijing Tianjin Hebei region and improve its practical ability of governance according to law.
