“治疗”缘何被略去?--“化学阉割”词语检视及性质探析

摘　　要：在法律(学)领域,英文“chemical castration treatment”在中文中常被称为“化学阉割”,“treatment”所包含的治疗、疗法的含义被忽略掉了。这种污名化的称谓,是语词学上的“暴政”,不仅会引起歧义,冒犯被适用者的人格尊严,而且有碍对“chemical castration treatment”性质为医学治疗还是刑事惩罚的探讨。无论是基于当事人主义自愿原则的医学治疗,还是基于法律家长主义强制原则的刑事惩罚,都应关注“treatment”词语中“治疗”的本义,以期为未来立法提供科学参考。Chemical castration treatment of male sexual offenders in legal sciences is often called"chemical castration",while the denotation of treatment and therapy inherently included in the term"treatment"has been ignored.This stigmatizing denomination keeps a linguistic"tyranny"against the positive side of this issue,causing ambiguity in any discussion and possibly negating the concept of human dignity.It equally prevents the question of whether the nature of"chemical castration treatment"is a medical one or a criminal penalty.Be it a medical treatment based on the principle of voluntariness or a sentence directed by legal paternalism,due attention should be paid to the original meaning of"treatment"in this regard in order to provide a scientific reference for future legislation.
