智慧司法背景下视听传输技术作证的证据评价

摘　　要：我国立法对待视听传输技术作证的态度呈现保守性特征,司法中的应用也具有边缘化倾向,此种处理之根源在于未能正确认识其证据价值。视听传输技术作证不仅能够保障证人讯问的品质,在加速程序、节省费用及实现当事人听审权等方面亦具有显著的意义。为发挥视听传输技术作证的应有证据价值,在解释论上,宜将《民诉证据规定》第68条第二款规定的双方当事人同意,解释为当事人未提出合理与充分的异议理由,从而真正摆脱《民事诉讼法》第73条“有正当理由不能出庭”的限定,以充分拓展视听传输技术作证的适用空间。在立法论上,应区分对待传输技术作证与书面证言、视听资料作证,确保视听传输技术作证相较于书面证言和视听资料作证的优先性,进而推动视听传输技术在民事诉讼中的应用普及化,以期有助于司法智能化和庭审实质化。China's legislation towards testimony of audiovisual transmission technology is attitudinal conservative,and its application in justice also tends to be marginalized.The root of such treatment lies in the failure to correctly recognize its evidence value.Such testimony can not only ensure the quality of witness interrogation,but also is significant in speeding up procedures,saving costs and guaranteeing the parties'right to hearing.In order to give play to the evidence value of audiovisual transmission technology,it is advisable to interpret the consent of both parties as provided in Article 68,Paragraph 2 of the Civil Proof Evidence Regulations as that the parties have not raised reasonable and sufficient grounds for objection,thus to truly overcome the limitation of"cannot appear in court with good reasons"as stipulated in Article 73 of"Civil Procedural Law"in order to fully expand the application of the testimony of audiovisual transmission technology.In terms of legislation,it is necessary to establish the norm that audio-visual transmission testimony takes precedence over written testimony and audio-visual material testimony,so as to promote the popularization of audio-visual transmission technology in civil justice,with a view to helping judicial intelligence and substantive trial.
