摘  要:我国的家庭教育地方立法属于创制型立法,具有探索性的特点,在界定家庭教育的内容、构建社会共治的责任体系、规定强制亲职教育、注重对特殊困境未成年人的帮扶、突出地方特色等方面进行了突破创新。在立法过程中对于家庭教育的定义、立法的性质、牵头部门的确定等难点问题存在着不同观点的争鸣。今后家庭教育立法应加强对父母教育权的尊重和保护,细化家庭教育指导服务的具体措施,增强立法的可操作性、避免立法重复。China's local legislation in family education is an innovative legislation with exploratory features,which defines the content of family education,builds a responsibility system for social governance,focuses on helping minors in special difficulties,stipulates mandatory parental education,and highlights local characteristics.In the legislative process,there are different opinions on difficult issues such as the definition of family education,the nature of the legislation,and the determination of the competent authority.In the future,family education legislation should strengthen the respect and protection for parental right of education,refine specific measures for family parenting guidance services,enhance the operability of legislation,and avoid duplication of legislation.
