债务性质未定前提下夫妻共同财产的执行

摘　　要：债务性质未明确时对夫妻共同财产的执行,实践中做法不一。不追加债务人配偶为被执行人而另行起诉的做法虽然没有一味地追求效率,但是无法弥补前诉中遗漏债务人配偶的错误;追加债务人配偶为被执行人继而执行夫妻共同财产的做法违反了审执分离的基本原则且与执行力主观范围扩张的理论不符;不追加债务人配偶为被执行人直接执行夫妻共同财产的做法未能正确适用现行法规范。对于该问题的解决,需要在实体法区分夫妻共同债务与夫妻连带债务的基础上采取不同的程序救济方式,夫妻共同债务的诉讼形态为固有的必要共同诉讼,需通过再审的方式进行救济,夫妻连带债务的诉讼形态为普通共同诉讼,应当告知债权人另行起诉。When the nature of the debt is unclear,the way of enforcing the joint property of the couple is different in practice.The practice of not adding the spouse of the debtor as the executed person is not a only pursuit of efficiency,but it is impossible to make up for the mistake of omitting the spouse of the debtor in the previous complaint.The practice of adding the spouse of the debtor as the executed person and enforcing the joint property of the couple violates the basic principle which the trail and execute should be separated and is inconsistent with the theory of the expansion of the subjective scope of enforcement.The practice of not adding the spouse of the debtor to directly enforce the joint property of the couple does not correctly apply the existing legal norms.To solve this problem,it is necessary to take different procedural relief methods on the basis of distinguishing between joint debt of the couple and joint and several debts of the couple in substantive law.The litigation form of joint debt of the couple is the true necessary joint action,which should be remedied by retrial.The litigation form of joint and several debts of the couple is the common joint action,the creditors should be informed to sue separately.
