摘 要:在线调解作为一种新兴的纠纷解决形式广受推崇,其未来的走向却不甚明朗,这主要是因为如何发展在线调解缺乏理论的支撑。技术—组织互构理论着眼于技术与组织相互建构的过程,集中体现社会治理中科技支撑与制度创新二者的关系,与在线调解的研究有良好的契合度。技术—组织互构理论视角下,技术对调解组织的塑造既包括正向的支撑,亦包括技术介入所产生的问题;而在线调解参与者的互动对技术应用的干预则清晰地展现了调解组织的环境、需求、逻辑对技术应用的制约。通过分析在线调解中技术与组织的关系,能够揭示技术介入过程中产生的问题,从而为在线调解的路径优化提供思路。While online mediation is widely applied as an emerging form of dispute resolution,its future is blurry for mainly lack of theoretical support on how to develop online mediation.The theory focuses on the process of mutual construction of technology and organization,and reflects the relationship between technological support and institutional innovation in social governance,which also fits well with online mediation research.This theory proposes that the shaping of mediation organizations by technology includes both positive support and problems arising from technical intervention;while the intervention of online mediation participants in the application of technology clearly shows the restricts of environment,demand,and logic of mediation organization towards the application of technology.By analyzing the relationship between technology and organization in online mediation,it can reveal the problems that arise in the process of technology intervention,so as to provide ideas for the optimization of online mediation paths.
