摘　　要：针对国际铁路工程承包项目因新冠疫情而停滞或终止的情况,以国际通行的FIDIC条款为基础,深入探讨后疫情时代国际铁路工程承包合同中对于不可抗力条款的使用,分析承包企业在受不可抗力影响项目中的可索赔性、索赔范围及项目终止清算时的费用偿付外延,为后疫情时代国际铁路工程承包合同的再签订做好风险预判,为履行中的国际铁路工程项目提供参考和借鉴。In view of the stagnation or termination of international railway engineering contract projects due to COVID-19,based on the internationally accepted FIDIC clauses,the paper discusses the use of Force Majeure clauses in international railway engineering contracts in the post pandemic era,and analyzes the claims of contractors in the projects affected by Force Majeure.The scope of claim and the extension of the payment of expenses during the termination of liquidation of the project will provide reference for the international railway project in the post pandemic era.
