论“增减挂钩”在国土空间规划中的扩展适用——以土地发展权转移的视角

摘　　要：在存量时代建设用地资源日益紧缺的形势下,城乡建设用地增减挂钩政策成为优化城乡土地资源配置、实现城乡统筹发展的重要抓手。从发展权视角切入,提出增减挂钩本质上是对"农转用"计划管理下土地发展权制度的补充;其空间运行机制取决于对城乡地租势差以及复垦与建新的边际成本和收益的考量;通过扩展政策实施范围、放松规划管制、引入市场机制,地方层面的创新实践提升了政策效能,实现了制度改进。在解析增减挂钩的政策内涵、阐释其运行的空间机制的基础上,从区域、城市、乡村三个层次提出了增减挂钩政策在国土空间规划中的扩展适用策略,以及对后续工作的启示。Under the circumstance of shortage in construction land supply at the era of inventory development,the policy of"increase and decrease link between urban and rural construction land"has become a substantial approach to optimize land resource allocation and achieve integrated urban and rural development.From the perspective of land development right,this paper points out that the"increase and decrease link"policy is in fact a supplement to the planned system of"transforming rural land to urban construction land"quota management.Its spatial operation mechanism depends on the considerations on urban-rural land rent divergence,and the balance between marginal cost of rural land reclaiming and marginal return of urban land leasing.Through measures including extending the policy application scope,loosening the planning restriction,and introducing the market system,the performance of the policy is improved in the innovative practice at local level,and an institutional improvement is also realized.On the basis of analyzing the connotation of the"increase and decrease link"policy and elaborating the operation of the spatial mechanism,this paper puts forward the strategy for extended application of the policy in territorial planning at three levels,i.e.,regional,municipal,and town and village,and its inspiration for future work.
