妨害新冠肺炎疫情防控犯罪典型案例分析

摘　　要：通过北大法宝、各地法院网站、裁判文书网收集经法院判决的妨害新冠肺炎疫情案例,对案例进行统计描述与分析,结果显示涉疫犯罪罪名繁多,涉及的刑事案件情节复杂,诈骗罪案例较多,妨害公务罪犯罪手段表现多样,疫情期间办案效率大有提高。建议精准界定涉疫犯罪罪名,依法严惩妨害疫情防控行为;加强事前防治宣传,结合行政和刑事手段。The paper collected the cases of COVID-19nuisance judged by the court through the PKULaw,the courts'websites and the referee's network,and made statistical description and analysis.The results showed that there were various charges of COVID-19crimes,complicated criminal cases involved,many cases of fraud,various criminal means of obstructing official duties,and the efficiency of case handling during the epidemic period.It is suggested that the charges of COVID-19crimes be precisely defined and that acts impeding COVID-19prevention and control be severely punished in accordance with the law,and strengthen prevention and control publicity beforehand,combine administrative and criminal means.
