摘 要:我国现行住房保障制度在保障公民基本住房权、维护社会公平方面发挥了重要作用,但产权型保障性住房面临土地供应难题,租赁型住房保障不能提供稳定的住房预期,导致住房保障问题上存在社会争议,政府面临压力,亟须制度创新和改进。《民法典》规定的居住权制度为住房保障制度发展提供了新的可能路径,将居住权引入住房保障制度,以保障性居住权制度克服传统住房保障方式的不足,有助于在政府住房保障资源有限的前提下更公平地满足基本住房需求"这需要充分理解民法居住权基本规则并加以合理运用,通过立法确认保障性居住权制度,特别是明确该制度推行的政府职责、保障范围和分配机制等内容,并贯彻落实到住房保障实践中,至少部分替代现行住房保障方式,逐步建立以保障性居住权制度为主体的住房保障制度。The current housing security system in China has played an important role in guaranteeing citizens'basic housing right and maintaining social equality.However,problems such as the land shortage of property-based affordable housing and the lack of stable rental housing expectation have caused public concerns and put the government under great pressure.In this context,system innovation and improvement are required.According to the Civil Code,the housing right has been included in the housing security system so as to overcome the weaknesses of the traditional system and meet the basic housing needs more fairly with limited government resources. Therefore,it is necessary to fuly understand the housing rights enshrined in the Civil Code and use it properly.Meanwhile,China should legislate to establish the afofrdable housing system and define the government duties,coverage and distribution mechanism of this system.With ways of current housing security partly replaced,China will put the new system into practice and establish the housing security system which mainly focuses on affordable housing system.
