摘　　要：目的:探讨法医精神病学鉴定中精神发育迟滞(MR)患者被性侵害案件特征。方法:采用回顾性分析方法,收集85例被性侵害MR患者的一般人口学资料、法医精神病学鉴定资料及案件特征;按鉴定结果将入组者分为MR轻度组与中重度组;对上述资料进行组间比较,并分析案件特征与性防卫能力的相关性。结果:MR轻度组49例,中重度组36例;MR轻度组的受教育程度(χ^(2)=21.96,P=0.000)、性防卫能力(χ^(2)=32.23,P=0.000)明显高于中重度组;被性侵次数明显多于中重度组(χ^(2)=6.21,P=0.046);案发时间(r=0.230,P=0.034)、反抗程度(r=0.216,P=0.047)与性防卫能力呈正相关。结论:MR轻度者容易遭受反复性侵害。性防卫能力越好的MR受害者案发时间越晚,反抗越积极。Objective:To explore the characteristics of sexual assault cases of mental retardation(MR)patients in forensic psychiatric identification.Method:The general demographic data,forensic psychiatric identification data and case characteristics of 85 sexually assaulted MR patients were collected by retrospective analysis.According to the identification results,the victims were divided into mild MR group and moderate-severe MR group.Then the above data between the two groups were compared and the correlation between case characteristics and sexual defense ability was analyzed.Results:There were 49 cases in the mild MR group and 36 cases in the moderate-severe MR group.The education level(χ^(2)=21.96,P=0.000)and sexual defense ability(χ^(2)=32.23,P=0.000)of the mild MR group were higher than those of the moderate-severe MR group,and the frequency of sexual assault was less than that of the moderate-severe group(χ^(2)=6.21,P=0.046).The time of the crime(r=0.230,P=0.034)and the degree of resistance(r=0.216,P=0.047)were positively correlated with sexual defense ability.Conclusion:Patients with mild MR are vulnerable to repeated sexual assault.The later the time of the crime of MR victims who have better sexual defense ability,the more active the resistance.
