摘　　要：重大犯罪案件侦查终结前讯问合法性核查制度的创设与建立,是非法证据排除规则在司法实践中的应用与发展,同时也具有规范证据合法性审查、提高司法效率的作用。《关于重大案件侦查终结前开展讯问合法性核查工作若干问题的意见》在实施中主要面临三个问题:讯问合法性核查主体是否能达到客观中立程度,核查内容和程序是否足以形成正确判断,核查结果是否能实现非法证据排除效果。由于非法证据排除制度司法实践本身发展较为滞后,需要从制度内生性的角度去寻求合乎实践的发展路径,即应当逐步确立驻所检察人员作为核查主体,完善核查案件范围和程序,改革卷宗移送制度。The establishment of the legality verification system of interrogation before the end of investigation of major criminal cases is a significant development of the exclusionary rule of illegal evidence in judicial practice,and it also plays a role in standardizing the examination of legality of evidence and improving judicial efficiency.After the publication of the opinions of the three organs,the system is faced with three prominent problems in its operation:whether the subject of legality verification can reach the degree of objective neutrality,whether the contents and procedures of verification are sufficient to form a correct judgment,and whether the verification results can achieve the effect of eliminating illegal evidence.Due to the lagging development of the judicial practice of the illegal evidence exclusion system,it is necessary to seek a practical development path from the perspective of system endogeneity,that is,we should gradually establish the resident prosecutors as the main body of verification,improve the scope and procedures of verification cases,and reform the file transfer system.
