摘　　要：明确三权分置的"三权"是指集体土地所有权、集体土地承包权和集体土地承包经营权的基础上,试图通过找到农地三权分置与房屋转租过程中的权利结构的相通之处。利用画结构图、对比分析等方法,以房屋转租后的权利结构为切入点,探析三权分置下土地的权利结构,并提出有针对性对策建议。The"three rights"should refer to collective land ownership,collective land contracting rights and collective land contractual management rights,this paper tried to find the similarities between the right structure of the three rights of farmland and the determination of the right structure in the process of house subletting;used the method of drawing structural diagrams and comparative analysis to analyze the three rights with the analysis of the right structure after the house subletting as the starting point.The right structure of the land under the division was analyzed and put forward some relevant legal advices.
